Your Privacy

These privacy terms explain how we collect, store, use and disclose personal information that we and/ or our Agent obtains from you.

In these terms, “we” or “us” means Janssen Insurance Limited (Janssen). “You” or “your” means the insured party from whom we are collecting personal information. “Agent” means the motor vehicle dealer or other agent acting on our behalf in marketing, arranging or selling insurance to you.

When we say “personal information” we mean identifiable information about an individual.

Consent

Your instructions to us or our Agent to assess insurance for you constitutes your consent to these privacy terms, even if you do not purchase our products or services.

We may amend the terms of these privacy terms from time to time and will notify you of any changes by posting an updated version on our website at: https://www.jansseninsurance.co.nz/privacy.html. It is your responsibility to check these terms periodically for any changes.

Personal information we collect

To evaluate your suitability for Insurance, we or our Agent will collect the following information about you and each other person who will be named on the Insurance Certificate.

  • Information requested from the disclosure questions during the insurance application process and
  • Other information about the risk profile of you and each other person who will be named on the Policy Certificate.

Each person named on the Policy Certificate will also be included on the insurance policy. If you provide information about other people named on the Policy Certificate, you confirm that you have their consent to do so.

We also require you to tell us any other information that may affect the insurance policy you seek that we do not already know about. This is a continuing obligation even after you have purchased insurance.

If you do not provide us with the information we ask for, we may not be able to properly assess your suitability for the insurance you seek, and we may decline to place insurance for you. In addition, your insurance may not be valid, and you may not be covered under the policy if you need to make a claim.

How we collect personal information

Our Agent will collect personal information from you on our behalf. We may also collect personal information from our contact with you (e.g. telephone or email), meeting with you face to face and when you purchase our products.

Who we collect your personal information from

We collect personal information from you when you provide that information to us, and from third parties where you have authorised this or where the information is publicly available.

If possible, we will collect personal information about you from you directly.

Who we may disclose your personal information to

We may disclose the personal information we hold about you to:

  • the Agent acting on our behalf in arranging insurance for you;
  • Quest Insurance Group Limited (contactable at 3 Te Kehu Way, Mount Wellington, Auckland 1060;
  • any other person or agency authorised by the Privacy Act 2020 or under other applicable laws; and
  • any other person or agency authorised by you.

How we use your personal information

Janssen and/or our Agent may use your personal information:

  • to verify your identity;
  • to assess suitability for the insurance you seek, including evaluating your risk profile and making premium and other underwriting decisions.
  • to provide our products and services to you;
  • to improve the products and services we provide to you;
  • to bill you and to collect money that you owe to us, including authorising and processing credit card transactions;
  • to respond to communications from you, including a complaint;
  • to conduct research and statistical analysis (on an anonymised basis);
  • to protect and/or enforce our legal rights and interests and the legal rights and interests of Janssen or related parties, including defending any claim; and
  • for any other purpose authorised by you or the Privacy Act 2020.

Janssen and our Agent may, with your consent, use your personal information to market products or services to you, including by contacting you directly (e.g. by text, phone or email).

Accessing and correcting your personal information

Subject to the grounds for refusal under the Privacy Act 2020, you have the right to access personal information that we hold about you, and the right to request that we update or correct any personal information we hold about you and other Named Drivers, as applicable. If you would like access to, or to correct or update the personal information you have provided, please email us your request in writing.

Storage, security and retention of your personal information

We will only keep the personal information you provide us for as long as is necessary for the purpose of evaluating the insurance you seek and providing you with our products and services, or any other purpose for which the information may lawfully be used.

If you do not purchase any products or services from us or cancel those products or services, we will delete your personal information after 5 years of you providing us that information OR of you notifying us of your cancellation or decision not to purchase.

We will take reasonable steps to keep your personal information safe from loss, unauthorised activity, or other misuse. If you believe there may have been a privacy breach, please contact Janssen as soon as possible.

International transfers

In order to provide you with our products and services, your personal information may be shared, transferred, disclosed and/or stored in countries other than New Zealand.

There may be differences between New Zealand’s privacy laws and those of the overseas locations in which your personal information (and other data we collect) is located. However, your personal information will only be provided by us to recipients outside New Zealand if permitted under applicable laws, including if we have reasonable grounds to believe that:

  1. the recipient is subject to New Zealand privacy laws;
  2. the recipient is subject to privacy laws in their country that offer similar protections to those under New Zealand privacy laws;
  3. the recipient agrees contractually to protect the information in a way that provides similar protections to those under New Zealand privacy laws; or
  4. we have your permission.
